Entities equipped to provide supplemental education services in communities where eligible migratory children and youth reside are eligible to apply. Such entities include public school districts; not-for-profit organizations subject to 26 U.S.C. 501(c)(3) of the tax code (26 U.S.C. 501(c)(3)); public institutions of higher education; public university laboratory schools approved by the Illinois State Board of Education (ISBE); charter schools, cooperatives, and other joint agreements with a governing body or board of control (e.g., area vocational centers, special education cooperatives); and schools operated by a Regional Office of Education, Intermediate Service Center, or state agency.

Uses and Restrictions
Any other funds to provide education for migrant students needs to be used first. Funds may only be used to carry out allowable activities under 34 CFR § 200.82. Institutions of Higher Education that receive a state award or federal pass- through award for a grant program administered by the Illinois State Board of Education will be restricted to a maximum indirect rate of 8% or other indirect cost rate calculated by their cognizant federal agency, whichever is less, pursuant to an exception to the Uniform Guidance (2 CFR 200) and GATA approved by the Governor’s Office of Management and Budget. This program is subject to federal non-supplanting requirements and grantees must use a restricted indirect cost rate that is referenced under 34 CFR 75.564-75.569, pursuant to federal regulations and an exception to the Uniform Guidance (2 CFR 200) and GATA approved by the Governor’s Office of Management and Budget.
Reports
Expenditure reports to be submitted on quarterly basis via IWAS. Programmatic reports are submitted on semiannual basis via IWAS. Final programmatic report due 30 days after completion of grant period.
Audits
In accordance with the provisions of 2 CFR 200, Subpart F - Audit Requirements, nonfederal entities that expend financial assistance of $750,000 or more in Federal awards will have a single or a program-specific audit conducted for that year. Non-Federal entities that expend less than $750,000 a year in Federal awards are exempt from Federal audit requirements for that year, except as noted in 2 CFR 200.503
Records
In accordance with Part 75 of the Education Department General Administrative Regulations (34 CFR part 75), and the Uniform Administrative Requirements in 2 CFR 200.333, program records must be maintained for 3 years, or longer depending on whether an exception to this rule applies.
