To provide grants to States and U.S. Territories to support nutrition services including nutritious meals, nutrition education and other appropriate nutrition services for older adults in order to maintain health, independence and quality of life. Meals and nutrition services are to be served in a congregate setting or delivered to the home, if the older adult is homebound.

27.12 The Area Agency on Aging agrees to administer the Area Plan in accordance with the Older Americans Act, the Area Plan and all applicable regulations, policies and procedures established by the Administration for Community Living and the Illinois Department on Aging. 27.13 The Area Agency on Aging must submit to the State Agency, for prior approval, any proposed contracts with profit making organizations to provide services under the Area Plan. 27.14 An Area Agency on Aging must be either an agency whose single purpose is to administer programs for older persons, or a separate organizational unit within a multipurpose agency which functions only for purposes of serving as the Area Agency. 27.15 The Area Agency on Aging will have the ability to develop an area plan and to carry out, directly or through contractual or other arrangements, a program in accordance with the plan within the planning and service area. 27.16 The Area Agency on Aging will conduct outreach efforts to identify older individuals eligible for assistance under the Act, with special emphasis on rural elderly, older individuals with greatest economic need (with particular attention to low-income minority individuals and older individuals residing in rural areas), older individuals with greatest social need (with particular attention to low-income minority individuals and older individuals residing in rural areas), older individuals restricted by the ability to perform daily tasks or the capacity to live independently due to noneconomic factors, including: physical or mental disability, language barriers, and cultural or social isolation caused by, among other things, racial and ethnic status, sexual orientation, gender identity, gender expression, or HIV status. 27.17 The Area Agency on Aging will ensure that each activity undertaken by the agency, including planning, advocacy, and systems development, includes a focus on the needs of low-income minority older individuals and older individuals residing in rural areas. 27.18 The Area Agency on Aging will coordinate planning, identification, assessment of needs, and provision of services for older individuals with disabilities, and individuals at risk for institutional placement, with particular attention to individuals with severe disabilities, with agencies that develop or provide services for individuals with disabilities. 27.19 The Area Agency on Aging has established and is following methods to take into account in connection with matters of general policy arising in the development and administration of the Area Plan, the views of recipients of services under the Area Plan. 27.20 The Area Agency on Aging has established and is following methods to assure that the Area Agency will serve as the advocate and focal point for older individuals within the community by monitoring, evaluating, and commenting on policies and programs, hearings, levies, and community actions which will affect older persons. 27.21 The Area Agency on Aging has established an Advisory Council consisting of older individuals (including minority individuals and older individuals residing in rural areas) who are participants or who are eligible to participate in programs assisted under the Older Americans Act, family caregivers of such individuals, service providers, representatives of the business community, representatives of older individuals, local elected officials, providers of veteran’s health care (if appropriate), and the general public, to advise continuously the Area Agency on all matters relating to the development of the Area Plan, the administration of the Area Plan and operations conducted under the Area Plan. 27.22 The Area Agency on Aging will provide a grievance procedure for older individuals who are dissatisfied with or denied services under Title III. 27.23 The Area Agency on Aging assures that funds received under Title III will not be used to pay any part of a cost (including an administrative cost) incurred by the Area Agency on Aging to carry out a contract or commercial relationship that is not carried out to implement Title III. 27.24 The Area Agency on Aging assures that funds received under Title III will be used to provide benefits and services to older individuals, and the Area Agency on Aging will give priority for services to older individuals identified in section 306 (a) (4)(A)(i) of the Older Americans Act. 27.25 The Area Agency on Aging assures that funds received under Title III will be used to provide, to the extent feasible, for the furnishing of services under the Older Americans Act, consistent with self-directed care. 27.26 The Area Agency on Aging assures that funds received under Title III will be used to include information detailing how the Area Agency on Aging will coordinate activities, and develop long-range emergency preparedness plans, with local and State emergency response agencies, relief organizations, local and State governments, and any other institutions that have responsibility for disaster relief service delivery. 27.27 The Area Agency on Aging will assure that no officer, employee, or other representative of the Area Agency on Aging is subject to a conflict of interest prohibited under the Older Americans Act and mechanisms are in place to identify and remove conflicts of interest prohibited under the Older Americans Act. 27.28 The Area Agency on Aging assures that the Area Agency on Aging and Older Americans Act-funded service providers will conduct outreach efforts that will— (A) identify individuals eligible for assistance under this Act, with special emphasis on— (i) older individuals residing in rural areas (ii) older individuals with greatest economic need (with particular attention to low-income older individuals, including low-income minority older individuals, older individuals with limited English proficiency, and older individuals residing in rural areas) (iii) older individuals with greatest social need (with particular attention to low-income older individuals, including low-income minority older individuals, older individuals with limited English proficiency, and older individuals residing in rural areas) (iv) older individuals with severe physical or mental disabilities (v) older individuals with limited English-speaking ability, or other language barriers (vi) older individuals with cultural or social isolation caused by racial and ethnic status, sexual orientation, gender identify, gender expression, or HIV status (vii) older individuals with Alzheimer’s disease and related disorders with neurological and organic brain dysfunction (and the caretakers of such individuals); and (B) inform the older individuals referred to in clauses (i) through (vii) of subparagraph (A), and the caretakers of such individuals, of the availability of such assistance. 27.29 Funds made available under Title III shall supplement, and not supplant, any Federal, State, or local funds expended by an Area Agency on Aging to provide services described in the Older Americans Act. 27.30 The Area Agency on Aging has established and is following methods that ensure that all services provided through the Area Plan are provided without the use of any means tests. 27.31 The Area Agency on Aging has established and is following methods that ensure that all older persons receiving services through the Area Plan are provided the opportunity to voluntarily contribute to the cost of the services.

Only States and U.S. Territories which have State Units on Aging designated by the governors are eligible to receive these grants.

Funds are made available to State Units on Aging and U.S. Territories for use by local nutrition projects. Local projects must provide an appropriate meal, which complies with the current Dietary Guidelines for Americans and provides one-third of the Dietary Reference Intakes (DRI). Meals must be provided at least once per day, 5 or more days per week, except in rural areas where such frequency is not feasible, to eligible people aged 60 and over and their spouses. Local projects may also use funds to provide nutrition education, nutrition counseling and other nutrition services, as appropriate, based on the needs of meal participants.

By requesting or receiving funds under this award, the recipient assures that it will carry out the project/program described in its approved state plan(s) and will comply with the terms and conditions and other requirements of this award. 3. SF-425 Financial Reporting: Grantee is required to submit SF-425s on a semi-annual basis. Beginning with this FFY2020 grant, the SF-425 and the “AoA Title III supplemental form to the SF-425” shall be submitted using the HHS’ Payment Management System (PMS). The “AoA Title III supplemental form to the SF-425” should be attached to the SF-425 in PMS. PMS website is located at: https://pms.psc.gov. Reports are due within 30 days for the periods ending March 31 and September 30 (i.e., due April 30 and October 30), through September 30, 2021, a final PMS drawdown and a final SF-425 are due within 90 days after September 30, 2021 (i.e., due December 30, 2021). If a final SF-425 report will be submitted December 30, 2021, a semiannual report is not required to be filed for report ending September 30, 2021. 4. Federal participation cannot exceed 75% of the total State and Area plan administration costs. The remaining 25% represents the State and local matching share. 5. Federal participation requirements under sections 304(d)(1)(D) (85% of total III-B, C-1, and C-2 service costs) and 309(b)(2) (1/3 of the 15% State matching share) of the OAA shall not apply to funds received under this grant award. 6. Federal Cash Reporting: On the SF-425 form, lines 10 a. through c. are reported on a quarterly calendar year basis (for the periods ending 12/31, 3/31, 6/30, 9/30) at the HHS’ Payment Management System (PMS). PMS website is located at: https://pms.psc.gov. Reconciliation of advances and disbursements is required for each quarter and the report must be completed within 30 days of the end of each quarter (i.e., by 1/30, 4/30, 7/30, 10/30). This reporting requirement is separate from completing the entire SF-425 as denoted in the financial reporting term.

In accordance with the provisions of 2 CFR 200, Subpart F - Audit Requirements, non-Federal entities that expend financial assistance of $750,000 or more in Federal awards will have a single or a program-specific audit conducted for that year. Non-Federal entities that expend less than $750,000 a year in Federal awards are exempt from Federal audit requirements for that year, except as noted in 2 CFR 200.503. In accordance with the provisions of Subpart F-Audit Requirements, under 45 CFR Part 75.500, nonfederal entities that expend financial assistance of $750,000 or more in Federal awards will have a single or a program-specific audit conducted for that year. Nonfederal entities that expend less than $750,000 a year in Federal awards are exempt from Federal audit requirements for that year. Except as noted in 45 CFR Part 75.500.
