Objective
The principal role of this Ombudsman Program is to investigate and resolve complaints made by or on behalf of residents of nursing homes or other long-term care facilities. Ombudsmen also promote policies and practices needed to improve the quality of care and life in long-term care facilities and educate both consumers and providers about residents' rights and good care practices.

The purpose of this funding opportunity for State Long-Term Care Ombudsman Programs is to enhance their capacity to respond to and resolve complaints about abuse and neglect, especially in residential care facilities and similar adult care homes, including assisted living facilities. Residents of these types of homes are less likely to have the benefit of federal oversight or regulation or clear requirements for preserving and respecting for their rights during the COVID-19 public health emergency, thus making the Ombudsman program presence essential. These funds will allow Ombudsman programs to develop capacity through activities such as hiring staff and recruiting and training volunteers to conduct visits and investigate complaints, develop resident and family councils, and provide information and assistance and education on resident rights and prevention of abuse and neglect. The Long-Term Care Ombudsman Program (LTCOP) is mandated by the federal Older Americans Act and supported by a provision in the Illinois Act on the Aging. The Illinois Department on Aging (Department or IDoA) established and operates the Office of the State Long-Term Care Ombudsman Program (SLTCOP). Regional LTCOP services are delivered through provider agencies by individuals designated by the State Long-Term Care Ombudsman and are operated through a grant between the Department and Area Agencies on Aging. Area Agencies on Aging (AAAs) provide administrative and advocacy support to the Regional Long-Term Care Ombudsman Programs in a number of key program areas. AAAs either serve as designated Regional LTCOP provider agencies or, in most instances, recommend Regional LTCOP provider agencies to the SLTCOP for designation, ensure Regional LTCOP services are delivered in accordance with applicable laws, rules, regulations, a State plan, the LTCOP Policies and Procedures, an application for the provision of LTCOP services, benchmark directives set by the SLTCOP, a notice of award, a Corrective Action Plan imposed by the SLTCOP, and the grant agreement between the Department and AAAs, provide support, and conduct legislative outreach to advance resident rights. The Long-Term Care Ombudsman Program works to protect and promote the rights and quality of life for long-term care residents. The program strives to ensure that existing state and federal laws as well as rules and regulations are adhered to, and that resident and family voices are heard during drafting or revision of laws or rules through the advocacy service components of the program. Complaint investigations are the program’s number one priority followed by consultations and inquiries, providing regular presence visits to facilities, community education, and conducting systems advocacy. Regular presence ensures that residents have information about their rights, while investigative services focus on the health, safety, welfare, and the rights of residents. ARP funding has been allocated for Regional LTC Ombudsman Program services. The goal is to increase routine access visits to all residential care communities . Funding can be used to augment staff as deemed appropriate. Increase presence at resident council meetings in RCCs. The goal is to increase presence by 10% Provide training opportunities for representatives of the Office to expand advocacy knowledge. Payment will be made as follows: Upon execution of the grant agreement Area Agencies on Aging may begin utilizing the monthly Cash Request form to request payments. Funds will be vouchered based on the approved monthly cash request on a reimbursement basis. Cash requests are due on or before the 10th of the month for the preceding month. Cash requests should be emailed to the LTCOP general email box. All state funds must be fully expended no later than September 30, 2025. The Grantee shall submit to the Office of the State Long-Term Care Ombudsman, the Ombudsman ARPA Funds Quarterly Reports on the following dates: On the 10th of the month following the pervious quarter. Those dates would be as follows: April 10, 2023 July 10, 2023 October 10, 2023 January 10, 2024 April 10, 2024 July 10, 2024 October 10, 2024 January 10, 2025 April 10, 2025 July 10, 2025 October 10, 2025 IDoA reserves the right to adjust final payments based upon expenditures as reported and reconciled by the Grantee. The sum of all payments shall not exceed the total grant amount and shall not provide the Grantee with more funds than the total of reported expenditures. Upon review and approval of the final reports, should IDoA determine funds were issued to the Grantee in excess of total expenditures, these funds shall be returned to IDoA within ten (10) calendar days of notification to the Grantee regarding the excess funds. Exhibit E: Performance Measures The Area Agency on Aging and Older Americans Act funded service providers will provide services to the following older adult demographic groups, at minimum, in proportion to their representation in the overall age 60+ population in the Planning and Service Area. For example, based on the most current census information available, if 25 percent of the total age 60+ population in a Planning and Service Area are individuals with greatest economic need, at least 25 percent of the Area Agency on Aging and service providers Total Client Served within a fiscal year must be older individuals with greatest economic need. 1. Older individuals with greatest economic need 2. Older individuals with greatest social need 3. Low-income minority older individuals 4. Older individuals with limited English proficiency; and, 5. Older individuals residing in rural areas. 6. Older individuals restricted by the ability to perform daily tasks or the capacity to live independently due to noneconomic factors, including: physical or mental disability, language barriers, and cultural or social isolation caused by, among other things, racial and ethnic status, sexual orientation, gender identity, gender expression, or HIV status. Exhibit F: Performance Standards Section 306 (a)(4)(A)(i) of the Older Americans Act The Area Agency on Aging will set specific objectives, consistent with State policy, for providing services to older individuals with greatest economic need, older individuals with greatest social need, and older individuals at risk for institutional placement; and will include specific objectives for providing services to low-income minority individuals, older individuals with limited English proficiency, and older individuals residing in rural areas, and include proposed methods of carrying out the preferences in the Area Plan. Section 306 (a)(4)(A)(ii) of the Older Americans Act Recipients under this funding opportunity must treat this grant as completely separate and distinct from any other federal grant. Funds awarded under one federal grant may not be used to cover expenses/activities under another grant. Federal funds cannot be used as match for other federal funds unless there is specific statutory authority to do so, 45CFR 75.306(b)(5). Funding made available through this opportunity may not be used to replace existing state, territory, or local funding already appropriated for the Long-Term Care Ombudsman Program and services. Existing funds for an existing project or activities may not be displaced by federal funds and reallocated for other organizational expenses. The funding through this opportunity must add to the state’s/territory’s current funding levels, not be used to replace funding. In addition to the uniform requirements in PART ONE, the Grantor has the following additional requirements for its Grantee: 27.1 This Grant Agreement is contingent on a final Grantor approved grant application from the Grantee. 27.2 The Area Agency on Aging shall report actual or suspected abuse, neglect, or financial exploitation of any adult with disabilities aged 18-59 or an adult aged 60 and older who does not live in a nursing home and comply with applicable reporting requirements for child abuse (relating to children or adolescents under age 18). 27.3 The Area Agency on Aging is required to submit Quarterly Financial and Program reports to the Illinois Department on Aging per the requirements of the Long-Term Care Ombudsman Program. Exhibit G: Project Specific Terms In addition to the uniform requirements in PART ONE and the Grantor-Specific Terms in PART TWO, the Grantor has the following additional requirements for this Project: 27.4 The Area Agency on Aging agrees to administer the ARP funds in accordance with all applicable regulations, policies and procedures established by the Illinois Department on Aging. 27.5 The Area Agency on Aging may not require the Regional LTC Ombudsman Programs to budget and develop matching funds for the awarded ARP grant funds. 27.6 The ARP funds have been allocated to expand Regional LTC Ombudsman Program services; therefore, the ARP grant funds may not be used to supplant existing Title III, Title VII, General Revenue Funds, and local funds allocated to the Regional LTC Ombudsman Programs. Additionally, ARP funds cannot be used to match Area Plan-related funds that support the Regional LTC Ombudsman Program or other Area Plan-related programs.

Uses and Restrictions
Funds are awarded to States to develop or strengthen service systems through designated State Agencies on Aging, Area Agencies on Aging and other entities. Funds under this Title and Chapter are included in State aging plans covering 2, 3, or 4 years, with annual revisions as necessary, submitted for approval to the Assistant Secretary for Aging. Funds must be used to design and implement programs for the provision of long-term care ombudsman services for individuals living in long-term care facilities.

By requesting or receiving funds under this award, the recipient assures that it will carry out the project/program described in its approved state plan(s) and will comply with the terms and conditions and other requirements of this award. 3. SF-425 Financial Reporting: Grantee is required to submit SF-425s on a semi-annual basis. Beginning with this FFY2020 grant, the SF-425 shall be submitted using the HHS’ Payment Management System (PMS). PMS website is located at: https://pms.psc.gov. Reports are due within 30 days for the periods ending March 31 and September 30 (i.e., due April 30 and October 30), through September 30, 2021, a final PMS drawdown and a final SF-425 are due within 90 days after September 30, 2021 (i.e., due December 30, 2021). If a final SF- 425 report will be submitted December 30, 2021, a semi-annual report is not required to be filed for report ending September 30, 2021. 4. Federal Cash Reporting: On the SF-425 form, lines 10 a. through c. are reported on a quarterly calendar year basis (for the periods ending 12/31, 3/31, 6/30, 9/30) at the HHS’ Payment Management System (PMS). PMS website is located at: https://pms.psc.gov. Reconciliation of advances and disbursements is required for each quarter and the report must be completed within 30 days of the end of each quarter (i.e., by 1/30, 4/30, 7/30, 10/30). This reporting requirement is separate from completing the entire SF-425 as denoted in the financial reporting term.
Audits
In accordance with the provisions of Subpart F-Audit Requirements, under 45 CFR Part 75.500, nonfederal entities that expend financial assistance of $750,000 or more in Federal awards will have a single or a program-specific audit conducted for that year. Nonfederal entities that expend less than $750,000 a year in Federal awards are exempt from Federal audit requirements for that year. Except as noted in 45 CFR Part 75.500.
