PROGRAM INFORMATION
Short Description
The Illinois General Assembly created the Statewide Deferred Prosecution Funding Program to provide grants to State's Attorneys to operate deferred prosecution programs for misdemeanor offenses, allowing for a misdemeanor charge to be dismissed upon successful completion of the program.
Deferred prosecution programs are offered at the pre-trial or prosecution phases to persons who have been charged with non-violent misdemeanor offenses.

Section 125. The amount of $1,500,000, or so much thereof as may be necessary, is appropriated from the General Revenue Fund to the Illinois Criminal Justice Information Authority for a grant to Statewide Deferred Prosecution Funding Programs for violence prevention and reduction, including administrative costs.
Objective
The program aims to: (1) hold those who commit crimes accountable for their actions (accountability) (2) reduce the probability of future criminal offending behavior (reduce recidivism); and (3) increase the effectiveness of the criminal justice system by reducing the cost of prosecuting people with non-violent offenses so that resources can be shifted to people with violent offenses thereby having a greater effect on public safety (effective resource allocation).

Application Procedures
Application must be submitted in AmpliFund.
Criteria Selecting Proposals
Applications will be reviewed by IJCIA staff and external experts. Review team recommendations will be forwarded to the ICJIA Budget Committee for approval. Applicants will be notified of the Budget Committee's decision.
Award Procedures
Review team recommendations will be forwarded to the ICJIA Budget Committee for preliminary approval and applicants will be notified of the Committee's decision. A panel will conduct a final review of applications for cost allowability.

Appeals
Unsuccessful applicants may request a formal appeal. Only the evaluation process is subject to appeal. Evaluation scores and funding determinations may not be contested and will not be considered by the ICJIA’s Appeals Review Officer. The appeal must be in writing and submitted within 14 calendar days after either the date the grant award notice is published or receipt of a Funding Opportunity Declination Letter from ICJIA, whichever comes first.
Renewals
Additional funding of up to 24 months may be awarded after the initial funding period, contingent upon satisfactory performance and availability of funds. Total funding for the grant program under a NOFO will not exceed 36 months.

Audits
Recipients must submit an annual audit report in accordance with the 2 CFR Part 200 Uniform Requirements. Future awards and fund drawdowns may be withheld if audit reports are delinquent.

In addition to implementing the funded project consistent with the approved project proposal and budget, agencies selected for funding must comply with applicable grant terms and conditions and other legal requirements, including GATA,
