Short Description
The purpose of this agreement is for the Office of Statewide Pretrial Services to support the provision of care coordination services including substance use, behavioral health, housing, and employment for justice-involved individuals during the pretrial phase of criminal prosecution. The Office of Statewide Pretrial Services is a direct- service provider of pretrial services in Illinois under the authority of the Illinois Supreme Court. The Office was created in August of 2021 in response to the passage of the SAFE-T Act, P.A. 101-0652. The Supreme Court formed this Office to achieve consistent, statewide pretrial practices and support the changes to the pretrial system brought about by bond reform. The pretrial phase of the criminal justice system begins when a person is accused of a crime and ends when the charges are resolved. Persons in the pretrial phase are presumed innocent. Supportive services for individuals released during the pretrial phase is paramount to the success of individual clients, OSPS, the SAFE-T Act and the criminal justice system. The supportive services facilitated by OSPS through this agreement will focus on care coordination. IDPH has available funding to support evidence-based strategies for individuals who are addicted to or abusing substances. OSPS and IDPH’s collaboration will bolster these evidenced-based strategies, provide direct linkage to care for defendants in the criminal justice system, enhance the State’s pretrial system and strengthen the State’s response to substance abuse. OSPS will facilitate the delivery of support services to justice-involved individuals released from custody before trial by doing the following: - Coordinating and facilitating the creation of eight or more support services positions working on the county level who will provide the following types of services - Facilitating the recruitment and training of qualified individuals to provide supportive services including substance use disorder treatment and harm reduction services. - Determining the counties where the support service positions will be placed to maximize the number of pretrial clients served. - Coordinating with the public defender, state’s attorney, judges and applicable stakeholders where the support services positions will be working. - Facilitating the education and training of key stakeholders within the judicial system around harm reduction, substance use disorder treatment providers and the availability of supportive services. - Facilitate data collection on services provided. - Providing the necessary equipment to individuals providing supportive services (computers, cell phones and data management systems).

Preapplication Coordination
Regardless of the source of funding (federal pass-through or State), all grantees are required to register with the State of Illinois through the Grant Accountability and Transparency Act (GATA) website, www.grants.illinois.gov, complete a prequalification process, and be determined "qualified" as described in Section 7000.70. Registration and prequalification is required before an organization can apply for an award. The entity is "qualified" to be an awardee if it: 1) has an active DUNS number; 2) has an active SAM.gov account; 3) has an acceptable fiscal condition; 4) is in good standing with the Illinois Secretary of State, if the Illinois Secretary of State requires the entity's organization type to be registered. Governmental entities, school districts and select religious organizations are not required to be registered with the Illinois Secretary of State. Criteria Selecting Proposals
Overdose Prevention - Pre-Trail Services –Year 22/23 is a non-competitive grant. All eligible applicants will receive a grant award. There are no merit-based review criteria for evaluating the applications. Each application will be reviewed for completeness and accuracy. Applications lacking any information required under Section D (2) above will be returned to the applicant for correction and resubmission The grantee must work closely with Office of Policy, Planning and Statistics, attest to meet grant deliverables, provide adequate budget and justification for allocation of project resources.
Award Procedures
A Notice of State Award (NOSA) shall be issued to the finalists who have successfully completed all grant award requirements and have been selected to receive grant funding. Illinois Department of Public Health - Office of Performance Management Page 6 of 6 The NOSA will specify the funding terms and specific conditions resulting from applicable pre-award risk assessments. The Illinois Department of Public Health (IDPH) is exempt from utilizing the standard NOSA issued on the GATA Grantee Portal. Successful applicants will receive an email notification from EGrAMS and must review the funding terms and specific conditions in the grant agreement and accept utilizing an electronically signature. Both the electronic signature in EGrAMS and a physical signature on the grant agreement must be completed by an authorized representative of the grantee organization and submitted to IDPH. A Notice of Denial shall be sent to the applicants not receiving awards via EGrAMS.

Appeals
Merit-Based Review Appeal Process For competitive grants, only the evaluation process is subject to appeal. Evaluation scores or funding determinations/outcomes may not be contested and will not be considered by the Department's Appeals Review Officer. To submit an appeal, the appealing party must: o Submit the appeal in writing and in accordance with the grant application document through IDPH's Merit-Based Review Appeal Request Form available in the GATA section of the IDPH website (www.dph.illinois.gov/GATA). Appeals must be received within 14 calendar days after the date that the grant award notice was published. Appeals must include the following information: The name and address of the appealing party, Identification of the grant, A statement of reasons for the appeal, If applicable, documents or exhibits to support statement of reason The IDPH Appeals Review Officer (ARO) will consider the grant-related appeals and make a recommendation to the appropriate Deputy Director as expeditiously as possible after receiving all relevant, requested information. The ARO must review the submitted Appeal Request Form for completeness and acknowledge receipt of the appeal within 14 calendar days from the date the appeal was received. o The ARO will utilize an Appeal Review Tool to consider the integrity of the competitive grant process and the impact of the recommendation. The appealing party must supply any additional information requested by the agency within the time period set in the request. The ARO shall respond to the appeal within 60 days or supply a written explanation to the appealing party as to why additional time is required..

Uses and Restrictions
Funding provided by IDPH may only be used on the following: Salaries and benefits for eight or more support services positions. Training and travel costs and any authorized travel expenses shall be reimbursed at rates consistent with the State of Illinois Travel Regulations and reimbursement rates promulgated by the Judicial Branch Travel Control Board, for individuals hired to provide support services. Education on harm reduction for attorneys, judges, law enforcement and other partners within the criminal justice system. Purchasing necessary equipment, services and supplies for use by the individuals hired into the support services positions. Data collection and information management systems to evaluate the effectiveness of the support services
Reports
The Grantee must work closely with IDPH OPPS participate in calls and meetings as scheduled. Grantees will also submit quarterly data reports and expenditure reports.
Audits
Article XV Audit Requirements: Audits Grantee shall be subject to the audit requirements contained in the Single Audit Act Amendments of 1996 (31 USC 7501-7507) and Subpart F of 2 CFR Part 200, and the audit rules and policies set forth by the Governor’s Office of Management and Budget. See 30 ILCS 708/65(c); 44 Ill. Admin. Code 7000.90.
