Short Description
Program to provide financial assistance to victims, witnesses and appropriate related persons who are actively aiding in the prosecution of perpetrators of violent crime and at risk of a discernable threat. The program shall offer funds requested by law enforcement agencies and, notwithstanding section (a), of 725 ILCS 173/15, used for the establishment of local violent crime witness protection programs.

Illinois Administrative Rules Authorization
Section 80. The amount of $30,000,000, or so much thereof as may be necessary, is appropriated from the General Revenue Fund to the Illinois Criminal Justice Information Authority to assist State's Attorneys and the Attorney General in protecting victims and witnesses who are aiding in the prosecution of perpetrators of violent crime, and appropriate related persons or victims and witnesses determined by the Authority to be at risk of a discernible threat of violent crime.
Objective
Provide relocation to witnesses and victims that actively aid in prosecution of perpetrators of violent crime, subject to the following limitations: 1) Emergency or temporary living cost 2) Moving expenses 3) Rent 4) Utilities 5) Security deposits for rent and utilities 6) Other appropriate expenses of relocation or transition 7) Mental Health treatment and 8) Lost wage assistance Outcomes include but are not limited to: the number of participants, the number of active cases closed; the number of relocations, reduction in violent crimes.

This state funding shall be in compliance with the following: - Administrative Requirements: 2CFR200.0 - 200.521 - Cost Principles: 2CFR200.400 - 200.476 - Audit Requirements: 2CFR200.500 - 20.521 Interest on Grant Funds. The Grant Funds awarded pursuant to this Agreement are subject to the requirements of the Cash Management Improvement Act and Treasury’s implementing regulations at 31 CFR Part 205 or 2 CFR 200.305(b)(8)-9. Thus, Grantee is not exempt from the provisions in Paragraph 4.7 of this Agreement. As such, Grantee can deposit Grant Funds in an interest-bearing account, and does need to remit interest to Grantor or to Treasury and is limited to using that interest for eligible uses under this Award. Grantee agrees to provide or make available all records related to this Award to Grantor or to Treasury upon request, and to any authorized oversight body, including, but not limited to, the Government Accountability Office (“GAO”), Treasury’s Office of Inspector General (“OIG”), and the Pandemic Relief Accountability Committee (“PRAC”). Policies, rules and guidelines for ICJIA funded program expenses should be reasonable and necessary, and therefore allowable under 2 CFR § 200, 2 C.F.R. § 200.403, 2 C.F.R. § 200.404. Civil Rights Law Compliance. In addition to the other non-discrimination and Civil Rights law compliance required in this Agreement, Grantee also certifies it is in full compliance with the terms and provisions of all legal requirements of the Treasury relating to non-discrimination and non-discriminatory use of federal funds. These requirements include ensuring that Grantee does not deny benefits or services, or otherwise discriminate on the basis of race, color national origin (including limited English proficiency), disability, age, or sex (including sexual orientation and general identity), in accordance with the following authorities: Title VI of the Civil Rights Act of 1964 (42 USC 2000d-1 et seq.) and the Treasury's implementing regulations, 31 CFR Part 22; Section 504 of the Rehabilitation Act of 1973 (29 USC 794), Title IX of the Education Amendments of 1972 (20 USC 1681 et seq.) and the Treasury's implementing regulations, 31 CFR Part 28; and the Age Discrimination Act of 1975 (42 USC 6101 et seq.) and the Treasury's implementing regulations at 31 CFR Part 23. Publications: Any publications produced with Grant Funds from this Award must display the following language: “This project [is being] [was] supported, in whole or in part, by the Illinois Criminal Justice Information Authority in accordance with 725 ILCS 173/1-25. Protections for Whistleblowers. In accordance with 41 USC 4712, Grantee may not discharge, demote, or otherwise discriminate against an employee in reprisal for disclosing to any of the list of persons or entities provided below, information that the employee reasonably believes is evidence of gross mismanagement of a federal contract or grant, a gross waste of federal funds, an abuse of authority relating to a federal contract or grant, a substantial and specific danger to public health or safety, or a violation of law, rule, or regulation related to a federal or state contract, including the competition for or negotiation of a contract, or grant. The list of persons and entities referenced in the paragraph above includes the following: • A member of Congress or a representative of a committee of Congress; • An Inspector General; • The Government Accountability Office; • A Treasury employee responsible for contract or grant oversight or management; • An authorized official of the Department of Justice or other law enforcement agency; • A court or grand jury; or • A management official or other employee of Recipient, contractor, or subcontractor who has the responsibility to investigate, discover, or address misconduct. Grantee shall inform its employees in writing of the rights and remedies provided under this paragraph, in the predominant native language of the workforce. Increasing Seat Belt Use in the United States. Pursuant to Executive Order 13043, 62 FR 19217 (Apr. 18, 1997), Grantee should encourage its contractors to adopt and enforce on-the-job seat belt policies and programs for their employees when operating company-owned, rented or personally owned vehicles. Reducing Text Messaging While Driving. Pursuant to Executive Order 13513, 74 FR 51225 (Oct. 6, 2009), Grantee should encourage its employees, subrecipients, and contractors to adopt and enforce policies that ban text messaging while driving, and Grantee should establish workplace safety policies to decrease accidents caused by distracted drivers.63.

Criteria Selecting Proposals
GATA Section 7000.350 Merit Based Review of Grant Application Proposals will be reviewed by a panel of ICJIA staff and stakeholders with expertise in services to victims of crime. Applicants will be selected based on overall scoring. Decisions on which projects to fund among applications with equivalent scores will be selected based on individual scores of the evidence-based practices category.
Award Procedures
Review team recommendations will be forwarded to the ICJIA Budget Committee for preliminary approval and applicants will be notified of the Committee's decision. A panel will conduct a final review of applications for cost allowability.

Appeals
GATA Section 7000.350 (g) Appeals Process Unsuccessful applicants may request a formal appeal. Only the evaluation process is subject to appeal. Evaluation scores and funding determinations may not be contested and will not be considered by the ICJIA’s Appeals Review Officer. The appeal must be in writing and submitted within 14 calendar days after either the date the grant award notice is published or receipt of a Funding Opportunity Declination Letter from ICJIA, whichever comes first.
Renewals
GATA Section 7000.450 Continuing Responsibilities Additional funding of up to 24 months may be awarded after the initial funding period, contingent upon satisfactory performance and availability of funds. Total funding for the grant program is based on appropriation and on NOFO so as not to exceed 36 months.

GATA Administrative Rules Section 7000.90 Auditing Standards Recipients must submit at minimum, a bi-annual audit report in accordance with the 2 CFR Part 200 Uniform Requirements. Program Manager may stipulate requirement for monthly audit reports. Future awards and fund drawdowns may be withheld if audit reports are delinquent.

Program Accomplishments
The overarching goal of the program is to support criminal justice practices and to enhance public trust and public safety. The results to be achieved and services rendered as a result of the program are: To support, protect victims and witnesses who fear retaliation for testifying against those accused of violent crimes. Support State's Attorney’s, or Chief Executives of a police agency protect victims, witnesses, and appropriate related persons, who are aiding law enforcement in the prosecution of violent crime, or at risk of a discernible threat of violent crime. Program accomplishments may be measured by the number of cases successfully prosecuted, and the relocation of victims, witnesses, and appropriate related persons for a period to be determined through successful participation in court proceedings and case closure. The case and court proceedings as determined by SAO schedules. Program accomplishments may be determined through the establishment of local violent crime witness protection programs by local police agencies. This program requires a VCWPP dedicated program coordinator for establishment of new programs and may include victim outreach for program participation.
