Grantee is responsible for developing and administering one or more programs or otherwise using the funds in accordance with applicable State and federal law. Grantee is responsible for all programmatic and administration requirements of the programs, including but not limited to submission of program and fiscal reports as required by state and, if applicable, federal government.

The sum of $1,750,000, or so much thereof as may be necessary, is appropriated from the Rental Housing Support Program Fund to the Department of Human Services for administration by the Illinois Housing Development Authority, for administration of the Rental Housing Support Program. Public Act 103-0006, Article 56, Section 545. The sum of $25,000,000, or so much thereof as may be necessary, is appropriated from the Rental Housing Support Program Fund to the Department of Human Services for administration by the Illinois Housing Development Authority, for rental assistance to the Rental Housing Support Program. Public Act 103-0006, Article 56, Section 550. The sum of $10,000,000, or so much thereof as may be necessary, is appropriated from the Illinois Affordable Housing Trust Fund to the Department of Human Services for administration by the Illinois Housing Development Authority, for administration of the Illinois Affordable Housing Act. The sum of $20,000,000, or so much thereof as may be necessary, is appropriated from the Build Illinois Bond Fund to the Department of Human Services for the Illinois Housing Development Authority for grants to municipalities with populations over 1,000,000 for rehabilitation of vacant and abandoned residential housing, including prior year costs.

Objective
RHSP Admin capped by administrative rule at 7 percent of the Rental Assistance Support Program appropriation. The Rental Housing Support Program (RHSP) was created in July 2005 to provide rental assistance to Illinois households by subsidizing rental housing units. It is a unit-based program targeting households who are at-or-below 30 percent of the Area Median Income (AMI) in their areas. A total of 50 percent of the resources are available for extremely low-income households who are at-or-below 15 percent of their AMI. IHDA administers the program overall, but contracts with local administering agencies (LAAs) around the state who manage the program in their communities, including finding and screening tenants. LAAs are funded in 3-year cycles. Funding for RHSP is derived from a $9 county-level mortgage documents recordation fee. The city of Chicago receives a statutory sub-allocation each year (43 percent). The Trust Fund administration resources are used for duly diligent underwriting, as well as required monitoring of the physical, financial and regulatory compliance for all Trust Fund grants loans in the IHDA portfolio, including audits, site visits and other monitoring activities. The Illinois Affordable Housing Trust Fund Program resources are used to provide loans and grants for the acquisition, rehabilitation and development of affordable rental housing, as well as neighborhood stabilization, homeownership and home rehabilitation programs for low- and very low-income families. The Capital Bill included funding for the development of affordable housing grants, loans, and investments for low-income families, low-income senior citizens, low-income persons with disabilities and at risk displaced veterans. The Capital Bill also includes the sum of $20 million for grants to municipalities with populations over 1,000,000 for vacant and abandoned residential housing. Legislation approved this as Public Act 101-0638, Section 385.

This Agreement may be renewed for additional periods by mutual consent of the Parties, expressed in writing and signed by the Parties. Grantee acknowledges that this Agreement does not create any expectation of renewal.

Reports
Time Period for Required Periodic Financial Reports. Grantee shall submit financial reports to IDHS pursuant to Paragraph 13.1 and reports must be submitted no later than two days before the deadline as established by DHS. Time Period for Close-out Reports. Grantee shall submit a Close-out Report pursuant to Paragraph 13.2 and no later than 45 days, or agreed upon date, after this Agreement’s end of the period of performance or termination. Time Period for Required Periodic Performance Reports. Grantee shall submit Performance Reports to Grantor pursuant to Paragraph 14.1 and such reports must be submitted must be submitted no later than two days before the deadline as established by the U.S. Treasury. Time Period for Close-out Performance Reports. Grantee agrees to submit a Close-out Performance Report, pursuant to Paragraph 14.2 and no later than 45 days, or agreed upon date, after this Agreement’s end of the period of performance or termination.
Audits
Grantee shall be subject to the audit requirements contained in the Single Audit Act Amendments of 1996 (31 USC 7501-7507) and Subpart F of 2 CFR Part 200, and the audit rules and policies set forth by the Governor’s Office of Management and Budget. 30 ILCS 708/65(c); 44 Ill. Admin. Code 7000.90.
Records
Maintenance of Program and Financial Records The Grantee will maintain records for five years after the end of the agreement period for audit purposes and participate in reporting required by IDHS and established by federal statute. Accessibility of Records. Grantee, in compliance with 2 CFR 200.337 and 44 Ill. Admin. Code 7000.430(f), shall make books, records, related papers, supporting documentation and personnel relevant to this Agreement available to authorized Grantor representatives, the Illinois Auditor General, Illinois Attorney General, any Executive Inspector General, the Grantor’s Inspector General, federal authorities, any person identified in 2 CFR 200.337, and any other person as may be authorized by Grantor (including auditors), by the State of Illinois or by federal statute. Grantee shall cooperate fully in any such audit or inquiry. Failure to Maintain Books and Records. Failure to maintain books, records and supporting documentation, as described in this ARTICLE XII, shall establish a presumption in favor of the State for the recovery of any funds paid by the State under this Agreement for which adequate books, records and supporting documentation are not available to support disbursement. Monitoring and Access to Information. Grantee must monitor its activities to assure compliance with applicable state and federal requirements and to assure its performance expectations are being achieved. Grantor or designee shall monitor the activities of Grantee to assure compliance with all requirements and performance expectations of the award. Grantee shall timely submit all financial and performance reports, and shall supply, upon Grantor’s request, documents and information relevant to the Award. Grantor or designee may make site visits as warranted by program needs. 2 CFR 200.329; 200.332. Additional monitoring requirements may be in PART TWO or PART THREE.
