Short Description
In May 2022, the United States Department of Treasury released initial guidance on the implementation of Section 9901 of ARPA, which creates the Coronavirus State Fiscal Recovery (“CSFR”) Fund to provide financial support to State governments for their responses to the impacts of COVID-19. The COVID-19 Affordable Housing Grant Program (CAHGP) (P.A. 102-0175) was created by the Illinois General Assembly to help provide vital gap financing for Low-Income Housing Tax Credit developments facing gaps due to the pandemic.

Illinois Statue Authorization
Public Act 103-0006, Article 123, Section 375. The sum of $1,049,747, or so much thereof as may be necessary, is appropriated from the State Coronavirus Urgent Remediation Emergency Fund to the Department of Human Services for the Illinois Housing Development Authority for grants and administrative expenses associate with COVID-19 Affordable Housing Grant Program, including but not limited to, for purposes allowed by Section 9901 of the American Rescue Plan Act of 2021 and any associated federal guidance, including prior year costs. Public Act 103-0006, Article 123, Section 380. The sum of $138,950,253, or so much thereof as may be necessary, is appropriated from the State Coronavirus Urgent Remediation Emergency Fund to the Department of Human Services for the Illinois Housing Development Authority for grants, forgivable loans and administrative expenses associated with affordable housing developments eligible for federal Low Income Housing Tax Credits and/or the COVID-19 Affordable Housing Grant Program, including but not limited to, for purposes allowed by Section 9901 of the American Rescue Plan Act of 2021 and any associated federal guidance, including prior year costs.

Administrative Code - Title 47, Chapter II, Part 371, Section 371.10: The Illinois Housing Development Authority (Authority) has been designated the program administrator of the HOME Investment Partnerships Program (HOME Program) in Illinois, established pursuant to Title II of the National Affordable Housing Act of 1990, 42 U.S.C. 12701 et seq., as amended (HOME Act). This Part is created to govern the HOME Program. This Part is authorized by, and made pursuant to, the Comprehensive Housing Affordability Strategy of the State of Illinois and the Illinois Housing Development Act [20 ILCS 3805].

This Agreement may be renewed for additional periods by mutual consent of the Parties, expressed in writing and signed by the Parties. Grantee acknowledges that this Agreement does not create any expectation of renewal.

Uses and Restrictions
Grantee certifies under oath that (1) all representations made in this Agreement are true and correct and (2) all Grant Funds awarded pursuant to this Agreement must be used only for the purpose(s) described herein. Grantee acknowledges that the Award is made solely upon this certification and that any false statements, misrepresentations, or material omissions will be the basis for immediate termination of this Agreement and repayment of all Grant Funds.
Reports
Time Period for Required Periodic Financial Reports. Grantee shall submit financial reports to IDHS pursuant to Paragraph 13.1 and reports must be submitted no later than two days before the deadline as established by DHS. Time Period for Close-out Reports. Grantee shall submit a Close-out Report pursuant to Paragraph 13.2 and no later than 45 days, or agreed upon date, after this Agreement’s end of the period of performance or termination. Time Period for Required Periodic Performance Reports. Grantee shall submit Performance Reports to Grantor pursuant to Paragraph 14.1 and such reports must be submitted must be submitted no later than two days before the deadline as established by the U.S. Treasury. Time Period for Close-out Performance Reports. Grantee agrees to submit a Close-out Performance Report, pursuant to Paragraph 14.2 and no later than 45 days, or agreed upon date, after this Agreement’s end of the period of performance or termination.
Audits
Grantee shall be subject to the audit requirements contained in the Single Audit Act Amendments of 1996 (31 USC 7501-7507) and Subpart F of 2 CFR Part 200, and the audit rules and policies set forth by the Governor’s Office of Management and Budget. 30 ILCS 708/65(c); 44 Ill. Admin. Code 7000.90.
Records
Maintenance of Program and Financial Records The Grantee will maintain records for five years after the end of the agreement period for audit purposes and participate in reporting required by IDHS and established by federal statute. Accessibility of Records. Grantee, in compliance with 2 CFR 200.337 and 44 Ill. Admin. Code 7000.430(f), shall make books, records, related papers, supporting documentation and personnel relevant to this Agreement available to authorized Grantor representatives, the Illinois Auditor General, Illinois Attorney General, any Executive Inspector General, the Grantor’s Inspector General, federal authorities, any person identified in 2 CFR 200.337, and any other person as may be authorized by Grantor (including auditors), by the State of Illinois or by federal statute. Grantee shall cooperate fully in any such audit or inquiry. Failure to Maintain Books and Records. Failure to maintain books, records and supporting documentation, as described in this ARTICLE XII, shall establish a presumption in favor of the State for the recovery of any funds paid by the State under this Agreement for which adequate books, records and supporting documentation are not available to support disbursement. Monitoring and Access to Information. Grantee must monitor its activities to assure compliance with applicable state and federal requirements and to assure its performance expectations are being achieved. Grantor or designee shall monitor the activities of Grantee to assure compliance with all requirements and performance expectations of the award. Grantee shall timely submit all financial and performance reports, and shall supply, upon Grantor’s request, documents and information relevant to the Award. Grantor or designee may make site visits as warranted by program needs. 2 CFR 200.329; 200.332. Additional monitoring requirements may be in PART TWO or PART THREE.
