Short Description
IDHS is administering the Court Based Legal Assistance program (a Named Appropriation legislative add-on) for grants to Illinois Counties with court-based eviction early resolution (diversion) programs and associated legal assistance, mediation and other related services. The purpose of this funding is to incentivize and support counties and courts to continue court-based eviction resolution (diversion) programs that have shown a lot of promise and impact during the pandemic. In Cook and most of these other counties, the funding for these programs to date came through the County from ARPA and other federal rescue funds that went directly to those local governments, so that there was no need for state funding. These court programs play an integral role in the effectiveness of other state funded interventions like legal aid and rental assistance by modifying the court process to help tenants in need to connect to these essential resources. Below is the list of counties that currently or have had court-based eviction diversion programs and eligible for this new state appropriation. Cook, Lake, McHenry, DuPage, Winnebago, Kane, Rock Island, Madison, St. Clair, Champaign, Dewitt, Douglas, Moultrie, Macon, Piatt, Jackson, Johnson, Massac, Pope, Saline, Union, Alexander.

SB0251, Public Act 103-0589, Article 63, Section 630. The amount of $2,000,000, that was appropriated from the General Revenue Fund to the Department of Human Services for grants to counties with court-based eviction early resolution programs and associated legal assistance, mediation and other services, to be distributed by the Department of Human Services in proportion to the volume of eviction filings by judicial circuit and prioritizing support for counties that are providing at least 50% in matching funding in State fiscal year 2024 by Article 56, Section 795 of Public Act 103-0006, as amended, or so much thereof as may be necessary and remains unexpended at the close of business on June 30, 2024, is hereby appropriated from the Fund for Illinois’ Future to the Department of Human Services for grants to counties with court-based eviction early resolution programs and associated legal assistance, mediation and other services, to be distributed by the Department of Human Services in proportion to the volume of eviction filings by judicial circuit and prioritizing support for counties that are providing at least 50% in matching funding.

A report will produced annually according to the requirements of the Act.
Audits
Grantee shall be subject to the audit requirements contained in the Single Audit Act Amendments of 1996 (31 USC 7501-7507) and Subpart F of 2 CFR Part 200, and the audit rules and policies set forth by the Governor's Office of Management and Budget. See 30 ILCS 708/65(c); 44 Ill. Admin. Code 7000.90
Records
Grantee shall maintain for three (3) years from the date of submission of the final expenditure report, adequate books, all financial records and, supporting documents, statistical records, and all other records pertinent to this Award, adequate to comply with 2 CFR 200.334, unless a different retention period is specified in 2 CFR 200.334 or 44 Ill. Admin. Code 7000.430(a) and (b). If any litigation, claim or audit is started before the expiration of the retention period, the records must be retained until all litigation, claims or audit exceptions involving the records have been resolved and final action taken.
